Description:

The Head of Commercial and Contracts is responsible for overseeing, managing and directing the Commercial & Contracts and Finance Teams and is accountable for providing commercial and contract support in all commercial deliverables to the other MPD Sections and project by providing commercial strategy, interfaces, progress updates, reporting contract risk analysis, benefits analysis, cost control and contract creation and closure. This includes the monitoring of activities and performance of the appointed Cost Consultants.

Key Responsibilities

Oversee project processes to enable the delivery of Major Projects all in accordance with budget, time scales, safety targets and procurement solutions.

Monitoring the activities, works and performance of the appointed PMCMs and Cost Consultants, Design Consultants, Contractors and Suppliers and ensure projects are in line with commercial and contracts
Ensure that Major Projects support and align with organizational strategy by overseeing project commercial and contracts from initiation to commissioning and handover in cooperation with the other MPD Sections.
Responsible for all commercial aspects of engagement with PMCM, Cost Consultants, Design Consultants, etc. and contracts and legal matters to ensure strategic objectives are aligned with each commercial deal and contract.
Responsible for manage the entire procurement, contract and commercial administration and cost control functions of a project from project inception phase to the completion phase, and implement commercial best practice to maximise value and minimize risk and cost.
Responsible for the delegation of project tasks to employees in the different teams under the Contract and Commercial Section based on individual strengths, skills sets and experience levels and coordinating internal resources for the execution of multiple projects.
Responsible for setting up, manage and modify cost control and contract management systems for all MPD projects.
Responsible for preparing, reviewing and managing project budgets and cash flows in partnership with the Cost Consultants by tracking project costs to meet budget and deadlines in coordination with the other MPD Sections.
Responsible for managing the preparation and monitoring the overall project budgets by aligning all supplier negotiations, expansion projects and business strategy with the budget.
Accountable for the reviewing of payment applications and invoices from Consultants, Contractors and Suppliers by ensuring alignment with the contract.
Responsible for the reviewing of project documents such as letters, reports, etc. to ensure alignment with contracts and procedures.
Responsible for the reviewing of proposal/tender documents and participating in tender process and tender evaluation and recommendation to ensure the tenders are as per company tender process and procedure for new and existing project contracts in coordination with the other MPD Sections.
Advise procurement strategy and oversee the project procurement process and procedures to ensure compliance with tendering procedures and rules.
Liaising, interfacing and meeting with internal and external parties, regulatory bodies and Project Stakeholders to ensure the execution of projects is in line with commercial and contracts to ensure the minimize operational disruptions.
Oversee and manage contracts with PMCMs, Consultants, Contractors and Suppliers in line with the other MPD Sections by assigning tasks and communicating expected deliverables.
Responsible for reviewing and evaluating changes/variations to contracts by ensuring justified grounds, reasons, basis and costs by setting up a change management system and process for different types of contracts.
Responsible for setting up, managing and modifying the functions related to contract, cost control, project and construction management systems by looking at existing and new contracts, analysis, negotiation, governance and closure of contracts in line with company processes.
Responsible for preparing, reviewing, monitoring and managing overall project budgets in partnership with the Cost Consultants by tracking project costs to meet budget and deadlines in coordination with the other MPD Sections.
Review and evaluate changes/variations to contracts to ensure justified grounds, reasons, basis and costing.
Assist with planning resources needed to reach objectives by assigning competent resources to the project to meet the complexity and scale of each project.
Assist in settling contractual disputes by analyzing claims and extensions of time by assisting other MPD Sections in the purchasing and contract buy-out of Contractors and Consultants to ensure consistency and compliance within the Company.
Assist with the settlement of contractual disputes by analyzing time and cost implications and advising and participating in dispute resolution proceedings options (mediation, arbitration, etc.).
Provide project updates on a consistent basis to the Senior Project Director, Client and various Stakeholders about commercial and contract strategy, adjustments and progress.
Responsible for reports for Senior Project Director and upper Management regarding the contracts & commercial status of projects and escalate any deviations by ensure action is taken to close any variances found.
Accountable for managing the relationship with relevant Cost Consultants to ensure team collaboration.
Attending, chairing and facilitating commercial and budget meetings/workshops to communicate budgetary objectives and adjust based on financial analysis if needed to ensure project deliveries.
Perform other department duties related to his/her position as directed by the Head of the Department.
Qualifications

About you:


Bachelor’s Degree or Equivalent with Minimum 10+ years of job-related experience
Recognized degree in Quantity Surveying/Engineering/Construction management or equivalent with minimum 25 years job-related experience.
Minimum 25 years of professional experience in quantity surveying and cost management of large/complex projects.
Minimum 10 years professional experience in pre and post contract functions in large International airport (>20 MAP) projects or large multi-phase projects.(Experience in operational airport environment preferred).
Minimum 5 years professional experience in contract administration of Project Management Construction Management and other Consultancy (e.g. Design & Cost Consultancy) Contracts.
Minimum 10 years site experience.
Registered as a Chartered Quantity Surveyor (MRICS) or equivalent.
Past experience in leading a commercial, contract, legal and finance teams.
Basic aviation rules and regulations applicable to construction activities.
Knowledge of quantity surveying and cost management software/system.
